Terms of Service

These Terms of Service ("Terms") govern your access to and use of WotsThat.com ("the Site", "we", "us", "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. About WotsThat

WotsThat.com is an image-guessing game platform where users can upload mystery images, submit guesses, earn points, and compete on leaderboards. The Site also includes a Mystery Zone where images of genuinely unknown objects can be submitted for community theory and AI-generated analysis.

2. Eligibility

You must be at least 13 years of age to use WotsThat. If you are under 18, you confirm that you have permission from a parent or legal guardian. By using the Site you represent that you meet these requirements.

3. Account Registration

To upload images, submit guesses, or appear on leaderboards, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Keep your password secure and not share it with others
  • Notify us immediately of any unauthorised use of your account
  • Take responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. User-Generated Content

When you upload an image or submit content to WotsThat ("User Content"), you retain ownership of that content. However, by uploading, you grant WotsThat a worldwide, non-exclusive, royalty-free licence to host, display, reproduce, and distribute that content on the Site and in promotional materials.

You confirm that any content you upload:

  • Is owned by you or you have the right to share it
  • Does not infringe any third-party intellectual property, privacy, or other rights
  • Does not contain nudity, sexual content, graphic violence, or material harmful to minors
  • Does not depict or glorify illegal activity
  • Does not include personally identifiable information about another person without their consent
  • Is not spam, deliberately misleading, or fraudulent

We reserve the right to remove any content that violates these Terms without notice.

5. Automated Moderation

All user-uploaded images are automatically reviewed by an AI moderation system before being published. Images that fail automated review are held for manual assessment. We aim to review held images within 24 hours. You will not be notified of every moderation decision, though you will see a status message if your upload is held.

6. Community Reporting

Users may report content they believe violates these Terms using the report button on any image. We review all reports. Submitting false or malicious reports in bad faith may result in account suspension.

7. Points, Leaderboards and Scoring

WotsThat operates a points system for correct guesses, fast solves, and stumping other users. Points and leaderboard positions have no monetary value and cannot be exchanged for cash or prizes unless we explicitly state otherwise in a specific promotion.

We reserve the right to adjust, reset, or remove points and leaderboard entries at any time, including in cases of suspected abuse or rule violation.

8. Prohibited Conduct

You agree not to:

  • Use automated bots, scripts, or tools to submit guesses or manipulate leaderboards
  • Attempt to reverse-engineer, scrape, or extract data from the Site without permission
  • Upload content designed to exploit, harm, or harass other users
  • Create multiple accounts to gain an unfair advantage
  • Interfere with the Site's security, infrastructure, or normal operation
  • Impersonate another user, company, or individual

9. Intellectual Property

All Site design, branding, software, and original content produced by WotsThat is owned by or licensed to WotsThat and protected by applicable intellectual property law. You may not reproduce, distribute, or create derivative works from our content without written permission.

10. Picture Quiz Maker (Teacher Feature)

Picture Quiz Maker is a feature that allows registered users acting as teachers ("Teachers") to select images from WotsThat's existing archive and package them into a custom quiz ("Class Game") for sharing with students via a unique link.

Teacher Responsibility

Teachers are solely responsible for selecting images and content appropriate for their own students. WotsThat does not review, moderate, or approve individual class games before they are created or shared. Teachers should preview a game's full content before sharing it with students.

Student Access

Students access a class game via a link shared directly by their Teacher. Students are not required to create a WotsThat account to play and are asked to provide only a first name, which is visible to the Teacher who created that game. WotsThat does not knowingly collect further personal information from students through this feature.

Age of Students

The eligibility requirements in Section 2 apply to registered WotsThat accounts, not to students accessing a class game via a shared link. Teachers are responsible for ensuring their use of this feature with any student, including students under 13, complies with applicable law and their school's policies, including obtaining any necessary parental or institutional consent.

Subscriptions

Access to create games via Picture Quiz Maker is provided on a paid subscription basis (monthly or annual, as displayed at checkout). Subscriptions renew automatically until cancelled. You can manage or cancel your subscription at any time via the billing portal linked from your account. Cancellation takes effect at the end of the current billing period. Fees are non-refundable except where required by law.

11. Third-Party Services

The Site uses third-party services including Supabase (database and storage), fal.ai (AI image processing), and Anthropic Claude (content moderation and mystery verdict generation). Your use of these services through the Site is also subject to their respective terms and privacy policies.

12. Disclaimers

WotsThat is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the availability, accuracy, or fitness for a particular purpose of the Site. We do not guarantee that the Site will be uninterrupted or error-free.

AI-generated mystery verdicts are produced for entertainment purposes only and should not be relied upon as expert identification or professional advice of any kind.

Fun facts displayed alongside archive images, including those used in Picture Quiz Maker games, are generated using AI and are provided for entertainment and general interest purposes only. They may contain inaccuracies and should not be relied upon as accurate, complete, or authoritative, including in an educational context. Teachers and users should independently verify any fact before relying on it for teaching or other purposes.

13. AI System Transparency (EU AI Act)

In accordance with Article 50 of Regulation (EU) 2024/1689 (the EU AI Act), we disclose the following about our use of AI systems:

You are interacting with an AI system when you:

  • Upload an image, which is automatically reviewed by an AI moderation system (see Section 5)
  • Submit an item to the Mystery Zone, where a community theory board and an AI-generated verdict are produced using Anthropic Claude
  • View daily challenge images and hints, whether on the Site or via our Chrome extension. Challenge images are user-submitted content; some users may have created or edited their images using AI tools before uploading. We do not control, and cannot always verify, whether a given challenge image was AI-generated by the uploader.
  • Use our Chrome extension, which displays the same challenge images and hints available on the Site and may rely on the same AI systems referenced above.
  • View a "fun fact" associated with a challenge image, on the Site or within a Picture Quiz Maker game, which is generated using AI and may contain errors.

Where our third-party AI providers support machine-readable marking of AI-generated content, we rely on that marking to help meet our disclosure obligations under Article 50(2). AI-generated images and verdicts on the Site are produced for entertainment purposes only, may contain errors, and should not be relied upon as expert identification or professional, legal, financial, or health advice.

We do not use AI systems on this Site to create deepfakes of real, identifiable people without their consent.

14. Limitation of Liability

To the maximum extent permitted by applicable law, WotsThat and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, including but not limited to loss of data, loss of revenue, or reputational harm.

15. Indemnification

You agree to indemnify and hold harmless WotsThat, its operators, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your use of the Site, your User Content, or your breach of these Terms.

16. Changes to These Terms

We may update these Terms at any time. We will post the updated version on this page with a revised effective date. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

17. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
